A potential misunderstanding leads to an arrest for Strong Arm Robbery (Robbery by Force in Georgia) and Criminal Mischief (Disorderly Conduct in Georgia).

Many people don’t realize that the crime of Robbery can happen as a result of a misunderstanding or defense, but its even more surprising when you are facing Robbery By Force Charges. On March 11, 2019 Conor McGregor was arrested in Miami, Florida for allegedly taking a phone from a fan, by force, and destroying that phone according to the Miami Herald and MMAJunkie. Why is this considered Robbery by force? Not taking into account for Florida, but in Georgia this crime occurs, as defined by our statute of O.C.G.A. 16-8-40, when property is taken from someone by use of force or sudden snatching. This particular crime carries 1-20 years in jail. This code should not be confused with Armed Robbery under O.C.G.A. 16-8-41 which would require the use of a weapon that places someone in fear of their lives.

McGregor was simply trying to stop a fan from harassing him, and after failed attempts he decided to remove the fan’s phone from their hands and smash it on the ground. In addition to the Robbery Charges he faces additional charges of Criminal Mischief in Florida which would be Disorderly Conduct in Georgia under O.C.G.A. 16-11-39. Under Georgia state law this crime involves, similar to the Florida charge, that the property of another person is taken from them violently and placed in danger.

Of course there are facts to every case where defenses can be raised for anyone charged with the crimes of Robbery, Armed Robbery or Disorderly Conduct. Each situation is different from the other and requires a evaluation of all the information in order to properly mount a defense and a effective negotiation with the prosecutor’s office.
